A lawsuit cannot move forward until the other party is properly notified, but what happens when that person seems to have vanished? In New York, a missing or evasive recipient does not end a case. In this article, we’ll explain how such recipients can be tracked, and what the courts allow when someone truly cannot be found.

Why Some Recipients Are Hard to Find

People become difficult to serve for very different reasons. To put it simply, the court treats an honest relocation differently from deliberate avoidance when deciding whether reasonable efforts were made.

    Outdated Addresses and Recent Moves

Many recipients are not hiding at all — they have simply moved. Old court records, expired leases, and forwarded mail leave a trail that no longer points to where someone actually lives. Because New York service of process rules require reaching the correct address, an outdated one leads to failed attempts and wasted time until the current location is confirmed.

    Avoiding Service on Purpose

Others deliberately dodge delivery by refusing to answer the door, screening visitors, or having family members claim they are not home. This kind of evasion is common, but it rarely works. New York law provides several ways to complete service even when a person actively avoids it, so hiding usually delays a case rather than defeating it.

What Happens If a Process Server Can’t Find Someone?

A single missed knock does not end the effort. A professional server follows a defined process that consists of:

    Multiple Service Attempts

A New York process server typically makes several attempts at different times — mornings, evenings, and weekends — to catch someone during their normal routine. Servers may also try a workplace or other known locations. These varied attempts show diligence and greatly improve the odds of reaching a person who keeps irregular hours.

    Documenting Every Attempt

Each attempt is logged with the date, time, location, and outcome. This documentation is essential. Before a court will permit an alternative method, it wants proof that New York process servers made genuine, good-faith efforts first. A detailed record turns repeated failures into the evidence needed for the next step.

What Are Your Options If the Recipient Still Can’t Be Found?

When direct delivery keeps failing, New York offers additional paths to valid service. Read on to find out more.

    Alternative Service Methods

New York permits substituted service, such as leaving documents with a person of suitable age and discretion at the recipient’s home or workplace, then mailing a copy. Another option available after diligent attempts is “affix and mail” service that posts the papers at the door and mails a copy.

Businesses follow a different path for New York service of process. Every corporation must keep a designated agent for service of process that New York law recognizes. It can also be served through the New York Secretary of State service of process system when its own agent cannot be reached.

    When Court Approval Is Required

If standard methods are impractical, a plaintiff can ask the court to authorize an alternative, such as service by publication or, in some cases, email. A judge grants this only after seeing documented, diligent attempts. Cutting corners here risks improper service of process that New York courts will not accept. It can later void a judgment, so following the process precisely protects the outcome.

How Skip Tracing Helps Locate Missing Recipients

When an address is stale, or a person is actively hiding, skip tracing is often what breaks the case open. It is the investigative work of finding someone who does not want to be found.

When Skip Tracing Is Worth Using

Skip tracing makes sense whenever repeated attempts fail, or the last known address proves wrong. Using databases, public records, address-change data, and other legal sources, a server can develop a current location that ordinary lookups miss.

What Information Helps Find Someone Faster

The more identifying detail you can provide, the faster skip tracing works. A full name, past addresses, date of birth, workplace, or known associates all give investigators a starting point. Even partial information can narrow the search and shorten the time to completed service.

When Professional Process Servers Make the Difference

Experience is what separates a completed service from a case stuck in limbo. Professionals bring tools and judgment that a frustrated plaintiff simply does not have. What are those?

    Handling Difficult-to-Locate Recipients

A seasoned server combines persistence, local knowledge, and skip tracing to reach people who evade ordinary attempts. Such servers know how to carry out each method so the service withstands a later challenge.

    Helping Keep Your Case Moving

By completing valid service quickly and documenting every step, a professional keeps your case on schedule and shields it from procedural disputes. This reliability matters most when a deadline is near, and a missed attempt could set everything back.

Choose the Best Approach When Someone Can’t Be Found

A recipient who cannot be found is a delay, not a dead end. New York gives you multiple ways forward (repeated attempts, substituted and posted service, skip tracing, and court-approved alternatives), but each depends on following the rules precisely and documenting the effort. Ultimately, when someone is hard to locate, professional help is the surest way to complete service correctly and keep your case moving.
