In New York, a missing or evasive recipient does not end a case. In this article, we’ll explain how such recipients can be tracked, and what the courts allow when someone truly cannot be found.

    People become difficult to serve for very different reasons. To put it simply, the court treats an honest relocation differently from deliberate avoidance when deciding whether reasonable efforts were made.

    Many recipients are not hiding at all — they have simply moved. Old court records, expired leases, and forwarded mail leave a trail that no longer points to where someone actually lives. Because New York service of process rules require reaching the correct address, an outdated one leads to failed attempts and wasted time until the current location is confirmed.

    Others deliberately dodge delivery by refusing to answer the door, screening visitors, or having family members claim they are not home. This kind of evasion is common, but it rarely works. New York law provides several ways to complete service even when a person actively avoids it, so hiding usually delays a case rather than defeating it.

    A New York process server typically makes several attempts at different times — mornings, evenings, and weekends — to catch someone during their normal routine. Servers may also try a workplace or other known locations. These varied attempts show diligence and greatly improve the odds of reaching a person who keeps irregular hours.

    Each attempt is logged with the date, time, location, and outcome. This documentation is essential. Before a court will permit an alternative method, it wants proof that New York process servers made genuine, good-faith efforts first.     The more identifying detail you can provide, the faster skip tracing works. A full name, past addresses, date of birth, workplace, or known associates all give investigators a starting point. Even partial information can narrow the search and shorten the time to completed service.
