    7 Things That Determine Your Car Accident Settlement Amount in Texas

    Most people who receive a car accident settlement offer have no idea how the number was calculated. The insurance adjuster presents a figure, explains it as fair, and waits. Many drivers accept it without knowing that the same crash, the same injuries, and the same evidence can produce settlement amounts that differ by hundreds of thousands of dollars, depending on how the claim is built and who builds it.

     

    The Texas Department of Transportation recorded 67,644 total crashes in Houston in 2023. Harris County leads all Texas counties in crash volume every year. For the injured drivers in those crashes, understanding what actually determines the settlement amount is the most practical knowledge they can have before signing anything.

     

    These are the seven factors that most directly shape what a Texas car accident settlement is worth.

    1. How Fault Is Assigned

    Texas uses a modified comparative fault system under Texas Civil Practice and Remedies Code Chapter 33. Every percentage point of fault assigned to the injured driver reduces their recovery by the same amount. A driver found to be 30 percent at fault on a 100,000 dollar claim recovers 70,000 dollars. A driver found to be more than 50 percent at fault recovers nothing.

     

    The fault assignment begins in the first adjuster call after the crash. Questions like “what were you doing just before the impact” and “did you have time to brake” are data collection tools. The answers given in that call become part of the fault analysis before the injured driver has reviewed the crash report or spoken with legal counsel. The single most effective way to protect the fault assignment is to decline a recorded statement until an attorney has reviewed the available evidence.

    2. The Completeness of the Medical Record

    The insurance carrier pays for injuries that are documented, not injuries that are reported. An injured driver who delays medical care creates a gap between the crash date and the first clinical record. Every day of that gap is an opportunity for the insurer to argue the injuries were caused by something other than the crash.

     

    The emergency record from the first post-crash medical visit is the foundational document. It must connect the injuries to the crash event through the mechanism of injury, the physical findings, and the treating physician’s assessment of what follow-up care is needed. A thorough initial record that clearly ties the clinical findings to the impact mechanism is worth more to the settlement calculation than multiple subsequent visits without that initial connection.

    3. Whether Future Medical Costs Are Projected Before Settlement

    This is the factor that most separates strong settlements from weak ones. An insurer’s first offer accounts only for past documented medical expenses. It does not include future physical therapy, specialist visits, surgical procedures, or long-term care costs that the treating physician has projected as necessary for recovery.

     

    A written prognosis from the treating physician, completed before any settlement discussion begins, converts projected future costs into a documented claim. Without it, the settlement is calculated on an incomplete medical picture. With it, the full economic cost of the injury has a foundation in the medical record rather than in the injured driver’s estimate.
